UK Off-Plan Pack

This is the paperwork side of buying a Dubai off-plan property from the UK, in the order it actually happens.

Four checklists. What to gather, how to verify the escrow account before you send anything, the payment sequence, and what to prepare if you end up needing a foreign power of attorney.

SECTION ONE

Document checklist

What a UK buyer is normally asked for. You do not need a UAE residence visa or an Emirates ID to own freehold property in a designated area.

On the reporting rules. For freehold property transactions, brokers must submit the applicable Real Estate Activity Report where cash payments reach AED 55,000 or more, or where all or part of the payment uses virtual assets or funds converted from virtual assets. That is a regulatory report. It does not mean your transaction is suspicious.
Warning sign. If proper identity and source of funds checks are missing altogether, treat that as a serious compliance concern about who you are dealing with.
SECTION TWO

Escrow verification steps

Do this before any money moves. Dubai Law No. 8 of 2007 requires a developer selling off-plan to open an escrow account with the Land Department.

What the law provides. Article 7 requires purchaser payments to be deposited with the escrow agent. Article 9 dedicates that account exclusively to constructing that project, and protects the money from attachment. Article 16 provides a prison term and a fine of not less than AED 100,000 for misappropriating money deposited in the escrow account. These protections have existed since 2007.
Before you transfer. Sending money to an unverified or incorrect account can put the payment at serious risk and make recovery much more difficult. If you are ever directed to a personal account, a broker's account, or a general company account rather than the project escrow account, verify it independently before anything moves. If anyone suggests splitting a payment to stay under a reporting threshold, stop dealing with them.

Remote payment sequence

The order things normally happen when you are buying from the UK. Individual developer procedures vary, so confirm yours.

Choose, with your own eyes on it

A live video call walking the actual site or show unit. A written price list with the payment plan on it, sent to you directly. And the project verified in the Land Department register.

Expression of Interest, if the developer uses one

Get it in writing whether it is refundable. An EOI is not a purchase.

Reservation form

You normally sign this yourself. A power of attorney is generally not required for the reservation.

Verify the escrow account, then pay the booking amount

Section two, every step, before the transfer leaves your bank.

Sale and Purchase Agreement

UAE law recognises electronic documents and signatures, but the developer's signing procedure can vary. Many developers support digital signing. Others may require couriered originals. Ask which, early, so you can plan around the post.

Dubai Land Department registration fee

Charged on the full purchase price, not on your deposit, and due near the start rather than at handover.

Oqood registration

Your entry in the interim property register. Registration sits with the developer. Your job is to confirm it has happened, and to keep the certificate.

Construction instalments

Into the same verified escrow account each time. Re-check the account details if a payment instruction ever arrives looking different from the last one.

Completion and registration in your name

Developers register completed projects in the property register on receipt of the completion certificate, and the Department may register an off-plan unit in the purchaser's name once the purchaser has fulfilled all contractual obligations. Confirm the specific completion process with your developer before booking any travel.

SECTION FOUR

Foreign power of attorney preparation checklist

You generally do not need a power of attorney to reserve, to sign the SPA, or to get your Oqood. It becomes relevant when you delegate a specific transaction to someone else.

Allow enough time. Potentially several weeks, because notarisation, UK legalisation, UAE attestation, courier delivery and Arabic translation can all vary. Start it well before you need it, not in the month your building hands over.
